These Terms and Conditions apply to all orders placed by consumers (B2C) and businesses (B2B). Any differences are expressly indicated.

 

§ 2 Formation of the Contract

The presentation of products in the online store does not constitute a legally binding offer.
By completing the order, the customer submits a binding offer.
The contract is formed upon receipt of an order confirmation via email, a shipping confirmation, or a payment request.

 

§ 3 Prices and Terms of Payment

All prices are listed in CHF or EUR, depending on the selected market. The prices shown do not include any customs duties, import taxes, or other charges that may apply in the country of destination and are to be borne in full by the buyer.

 

§ 4 Delivery and Shipping

Delivery is handled by FedEx. Delivery takes 5–10 business days from the date of the shipping confirmation. Customs duties and import fees are the responsibility of the recipient.

 

§ 5 Retention of Title

The goods remain the property of Real Street Performance GmbH until full payment has been received.

 

§ 6 Warranty

For buyers residing in Switzerland, the statutory warranty period of 2 years applies in accordance with the Swiss Code of Obligations (CO Art. 197 et seq.).

EU Consumers: 2 years
Businesses: 1 year

Damage resulting from improper installation, incorrect tuning, overloading, use in motorsports, or modification is excluded.

 

§ 7 Limitation of Liability

No liability is assumed for lost profits, consequential damages, data loss, or business interruption, except in cases of willful misconduct, gross negligence, or personal injury.

 

§ 8 Notice Regarding Motorsports and Performance Parts

Many of the products offered are intended exclusively for motorsports or off-road use.

Installation may only be performed by qualified professionals.

§ 9 Right of Withdrawal

Buyers residing in the European Union have the right to withdraw from this contract within 14 days without providing a reason. The withdrawal period is 14 days from the day the goods were received. To exercise your right of withdrawal, please contact us via email. The buyer is responsible for the return shipping costs. The right of withdrawal does not apply to goods that were custom-made according to customer specifications.

§ 11 Governing Law and Jurisdiction

These General Terms and Conditions are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for disputes arising from or in connection with these General Terms and Conditions is Schaffhausen, Switzerland. For consumers residing in the EU, mandatory consumer protection provisions of the respective EU member state remain reserved.
